§ 1 Scope of application
1.1 Cruise & Ferry Center GmbH (hereinafter “CFC” or “Ferrycenter”) is the owner and operator of the website ferrycenter.de.
1.2 These GTC govern the business relationship between CFC and persons who conclude a contract with it for the purpose of arranging a ferry crossing (hereinafter “Customer”). The services offered on the ferrycenter.de Internet platform are aimed equally at consumers and entrepreneurs. For the purposes of these GTC, a customer is any natural person who concludes the contract for a purpose that cannot be attributed to their commercial or independent professional activity and an “entrepreneur” is a natural or legal person or a partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding the contract.
1.3 By commissioning the Provider, the Customer accepts these Terms and Conditions.
1.4 Deviating provisions shall only apply if they have been expressly agreed in writing between CFC and the customer.
1.5 CFC is free to deviate from these provisions and/or to offer services not included in these provisions by written agreement with its client.
1.6 Although the masculine form has been chosen in these GTC for reasons of readability, the information refers to members of all genders.
1.7 The information provided by Ferrycenter makes no claim to completeness or accuracy.
§ 2 Subject matter of the contract
2.1 Ferrycenter compares prices and timetables for ferry crossings and allows the customer to book ferry crossings. In the event of a booking, the relevant contract of carriage shall be concluded exclusively between the customer and the ferry operator concerned. Ferrycenter works exclusively as an intermediary and does not carry out ferry crossings itself. The debtor of the transportation service is solely the respective shipping company. Responsibility for the actual transportation lies with the ferry operator, whose general terms and conditions apply in full, are mandatory and take precedence.
2.2 The customer making the booking on ferrycenter.de undertakes to have the permission of all passengers to make the booking on their behalf. He must ensure that all booking information is correct and complete and is responsible for all disadvantages resulting from inaccurate information. Furthermore, he/she is responsible for the contractual obligations (in particular also for the payment of the travel price) of the registered fellow travelers.
2.3 The contract is concluded when the booking form is submitted.
§ 3 Prices
3.1 The prices are calculated according to the vehicle type entered (length, height, width), the number of passengers, route(s), travel dates and times. All prices for the journey are shown including VAT/sales tax and all other taxes as well as all fees, unless otherwise indicated or stated in the confirmation e-mail.
3.2 Roof boxes, bicycle racks or other accessories attached to the vehicle must be included in the dimensions. If not, this may lead to additional costs on site.
3.3 A booking fee will be charged per reservation/booking in favor of CFC. This is listed on the booking page.
3.4 Special tariffs or other special offers may be subject to special conditions that deviate from these GTC.
3.5 The information provided to customers is based on Ferrycenter’s own databases and on databases of third parties. Ferrycenter endeavors to keep databases up to date, but assumes no liability with regard to the accuracy, completeness and timeliness of the data.
§ 4 Embarkation
4.1 All departure and arrival times are based on estimates by the ferry operator and are given in local time. Due to various circumstances, schedules may be changed and/or canceled. CFC accepts no responsibility for any costs incurred as a result of such circumstances.
4.2 The customer shall ensure that he/she arrives at the booked departure point with the lead time specified by the respective shipping company. He shall also ensure that he familiarizes himself with the exact check-in obligations and conditions of the respective shipping company.
4.3 In the event of late arrival at the port of embarkation, transportation may be refused. Ferry operators are also authorized to charge additional fees in the event of late arrival at the port of embarkation.
§ 5 Vehicles and luggage
5.1 The customer and his fellow travelers are obliged to comply with all provisions of all laws and international conventions applicable to the transport of dangerous goods and dangerous luggage.
5.2 Vehicles that run on liquid gas must be specified as such when booking.
5.3 Only crossings for tourist purposes can be booked via Ferrycenter. For freight tariffs, the respective ferry operator must be contacted separately and independently. Freight goods include commercial goods (including samples, tools, household removals, collections, freight trailers, etc.; this list is not exhaustive).
5.4 Random checks of persons and vehicles may be carried out in accordance with the respective regulations of the ferry company. Passengers who do not comply with the regulations may be refused embarkation and will not receive a refund.
5.5 The categories of vehicle length, vehicle height etc. vary depending on the ferry operator. Camping vehicles must be declared as such and declared as such in the vehicle documents.
§ 6 Pets
6.1 It is possible to take pets with you. Pets must be specified at the time of booking. A fee will be charged for transportation.
6.2 The respective animal owner is responsible for the transportation and import of live animals. The regulations of the ferry operators as well as the import and export of live animals may vary from country to country. It is advisable to consult a vet in good time before departure to ensure that the necessary conditions (health and vaccination certificates, etc.) for import and export are met.
6.3 The customer shall ensure that they have familiarized themselves with the exact terms and conditions of the Redeemer regarding pets.
§ 7 Entry requirements
7.1 The customer is responsible for observing and complying with all government regulations and laws relating to the voyage at all ports visited by the ferry during the course of the voyage.
7.2 The customer and all fellow passengers must present valid travel documents (passport or travel ID) as well as visas and entry or exit permits, proof of vaccination, etc. required at any port on the ferry’s itinerary.
7.3 All disadvantages arising from non-compliance with these provisions shall be borne by the customer. There is no entitlement to reimbursement in this case.
§ 8 Confirmation and payment
8.1 Upon conclusion of the contract between the shipping company and the customer, CFC accepts the customer’s payments on behalf of the shipping company.
8.2 Payment shall be made by credit card, Google Pay, Apple Pay or instant bank transfer. In the case of agency collection, invoices are due immediately upon receipt and must be paid by bank transfer to Cruise & Ferry Center GmbH.
8.3 The travel documents will be sent to the e-mail address provided during the booking process once payment has been received.
8.4 The booking confirmation also constitutes an invoice in the name of the shipping company if there is no agency collection.
8.5 If the customer has not received a confirmation within two hours of making payment, the customer should check the spam inbox. If no travel confirmation has been received there either, it is the customer’s responsibility to inform CFC of this by sending an e-mail message to [email protected].
§ 9 Fees
9.1 For changes or cancellations of the booked services, the CFC reservation center must be contacted in writing by e-mail message to [email protected].
9.2 In the event of changes, cancellations and rebookings of a trip, a processing fee will be charged per order and transaction. From the third rebooking onwards, CFC will charge EUR 60.00 per order and transaction. These fees are not covered by cancellation insurance.
9.3 Changes, cancellations and rebookings are subject to the general terms and conditions of the respective ferry operator, which may provide for restrictions and additional costs. These conditions apply in full, are binding and take precedence. CFC is also authorized to charge an additional EUR 19.00 processing fee in the event of a cancellation or rebooking initiated by the customer.
9.4 In the event of a no-show without prior notice, the entire trip is considered canceled and no refund can be granted.
9.5. Requests for rebookings and changes to the booking must be submitted in writing to [email protected] at least 48 hours (if submitted Monday to Wednesday) or 96 hours (if submitted Thursday or Friday) before departure. CFC cannot guarantee the timely processing/adjustment of requests for changes submitted at short notice prior to departure.
§ 10 Liability and warranty
10.1 The customer is obliged to check the documents received from CFC carefully and to inform CFC immediately of any discrepancies. CFC is not liable for any damage resulting from discrepancies and/or errors that are not reported back.
10.2 CFC’s liability under the brokerage contract is limited to twice the contract price.
10.3 Claims against CFC must necessarily arise from the brokerage contract concluded with the customer or from a breach of the obligations arising from this brokerage contract. CFC is not liable for defective performance by the ferry operator. All ferry operators involved shall be directly liable to the customer for the provision of their services within the framework of the statutory provisions and international agreements. The general terms and conditions and transportation regulations of the respective ferry operator apply in full, are mandatory and take precedence. The customer can find the general terms and conditions of the shipping company on the respective provider’s website.
10.4 Any liability of CFC as a result of the insolvency of a ferry company is excluded.
10.5 CFC accepts no liability for death or personal injury, for destruction, loss or damage to luggage or vehicles or for delays in arrival on ferry crossings arranged by CFC.
10.6 Despite careful control of the content, CFC assumes no liability for the content of external links. The operators of the linked pages are solely responsible for their content. The same applies to other information contained on this Internet platform.
10.7 Cruise & Ferry Center GmbH is not liable for the availability of the transport service at the time of booking or for the provision of the booked transport service.
10.8 The restrictions of paragraphs 1 to 6 shall also apply in favor of the legal representatives and vicarious agents of Cruise & Ferry Center GmbH if claims are asserted directly against them.
§ 11 Passenger rights
11.1 Regulation (EU) No. 1177/2010 of November 24, 2010 concerning the rights of passengers when travelling by sea and inland waterway establishes the rights of passengers, including disabled persons and persons with reduced mobility, when travelling by sea and inland waterway in the European Union. In the event of an irregularity (e.g. a delay or cancellation), this regulation may provide for extended protection rights for passengers, such as hotel accommodation, snacks, meals and fare reductions.
11.2 Any claims arising from Regulation (EU) No. 1177/2010 of November 24, 2010 concerning the rights of passengers when travelling by sea and inland waterway must be asserted directly against the ferry operator. The basis for a fare reduction within the meaning of Art. 19 of this Regulation is the fare excluding the agency fee charged by CFC.
§ 12 Severability clause
Should individual provisions of the GTCs, including these provisions, be or become invalid in whole or in part, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The respective statutory provisions shall apply in place of the invalid or missing provisions.
§ 13 Final provisions
13.1 Place of jurisdiction: The exclusive place of jurisdiction for all legal disputes arising from this contract shall be the registered office of CFC, provided that you are a merchant, a legal entity under public law or a special fund under public law.
13.2 Choice of law: Unless mandatory statutory provisions
provisions of your home law to the contrary, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
